Probation Period (UAE)
Definition

UAE probation periods are typically up to 6 months, during which termination rules differ from confirmed employment.
Probation under Federal Decree-Law No. 33/2021
UAE employment contracts may include a probation period of up to six months for new hires. During probation, termination notice periods and end-of-service entitlements differ from confirmed employment. The law allows either party to terminate with shorter notice — typically 14 days — though exact terms must align with the registered MOHRE contract.
Rights that continue during probation
Probation does not suspend all statutory rights. Employees accrue annual leave at the reduced first-year rate of two days per month. WPS salary payment obligations apply fully — probationary status is not grounds for delayed or partial wage payment. MOHRE expects probation terms explicitly stated in the employment contract template, not implied verbally.
Confirmation and extension
Probation cannot exceed six months unless the law permits extension in specific circumstances. Automatic confirmation upon completion is standard unless termination occurs. SMEs sometimes terminate on day 179 to avoid gratuity accrual thresholds — a practice MOHRE scrutinises when employees file complaints alleging disguised dismissal to deny benefits.

Example
Vertex Design Studio hired a project coordinator on six-month probation with MOHRE-registered 14-day notice. At month four, the manager terminated with three days' notice and no settlement, assuming probation meant no obligations. The employee filed a MOHRE complaint. Inspectors ordered notice-period salary payment and confirmed accrued leave encashment because termination violated registered contract terms.
Compliance risks
Improper probation termination — insufficient notice, unpaid accrued leave, or WPS non-payment — triggers MOHRE fines and employee complaint pathways. Misusing probation to avoid gratuity by pattern-terminating before one year attracts inspection scrutiny. Contract terms not registered in MOHRE templates weaken employer defences in disputes.

Frequently asked questions
What is Probation Period (UAE)?
UAE probation periods are typically up to 6 months, during which termination rules differ from confirmed employment.
Can UAE probation be extended beyond six months?
Federal Decree-Law No. 33/2021 caps probation at six months in standard employment relationships. Extension beyond this limit requires specific legal grounds. Employers who keep employees on perpetual probation risk MOHRE findings that confirmed employment began earlier, triggering full statutory entitlements retroactively.
