Annual Leave (UAE)
Definition

UAE employees are entitled to 30 calendar days annual leave after one year of service.
Annual leave entitlement under UAE law
Federal Decree-Law No. 33/2021 grants employees 30 calendar days of paid annual leave after completing one year of continuous service. During the first year, employees accrue two days per month. Leave is a statutory right — employers cannot substitute unpaid time off or deny accrual except under specific provisions in the law and employment contract.
Leave management for SMEs
Annual leave interacts with payroll, WPS, and final settlement. Unpaid leave taken beyond entitlement creates wage deductions that must appear correctly in SIF files. Unused leave at termination converts to encashment payable alongside gratuity — a line item MOHRE expects on final settlement documentation. High-growth SMEs without leave tracking often discover negative balances only at exit.
Public holidays and carry-over
UAE public holidays do not count against annual leave unless the employer's policy explicitly treats them differently. Carry-over rules depend on company policy within legal minimums. MOHRE disputes frequently arise when employers refuse encashment of accrued but unused leave at termination, claiming expired carry-forward policies that contradict statutory minimums.

Example
BlueWave Marketing, a 27-employee Dubai agency, allowed unlimited leave carry-over verbally but had no system tracking balances. When a senior designer resigned after three years with 47 unused days, finance offered 30 days encashment citing policy. MOHRE mediation ordered full accrued balance payment plus gratuity, costing AED 22,000 more than budgeted because leave was never tracked against contracts.
Compliance risks
Denying statutory annual leave or underpaying leave encashment at termination triggers MOHRE employee complaints and fines. Incorrect leave deductions in WPS files also create compliance flags. SMEs face back-payment orders for denied leave plus reputational damage in tight talent markets where leave policy transparency matters.

UAE employees are entitled to 30 calendar days annual leave after one year of service.
Are UAE public holidays deducted from annual leave balance?
